1. Prim Folk’s Obligations
(a) Display/Listing. Prim Folk will display and list Goods clearly and legibly in appropriate categories.
(b) Marketing/Advertising. From time to time Prim Folk may use images, ad copy, or other information pertaining to Goods for the purpose of
marketing, advertising, store banner creation or other in-store online display marketing. Advertising costs are the sole responsibility of Prim Folk.
(c) Right of Sale. Prim Folk has the right to list and sell designer's Goods through its online store and/or published catalog.
Prim Folk will not distribute or sell Goods on any other site or through any other venue.
(d) Orders. Prim Folk will email orders to the seller for shipment.
(e) Payments. Sellers are paid 60% of each sale. Commissions are held in an online escrow account and are paid out on the 1st and 15th of a month. When either day falls on a weekend,
payments are made on the Friday before or Monday following. Escrow accounts may be viewed online by the seller using a login ID & password assigned to them.
2. Designer’s Obligations
(a) Pricing. Designer sets the retail price (inclusive of shipping costs) for their products.
(b) Production of Goods. Designer is responsible for providing all images, copy, and information for listing products on Prim
Folk and agrees to have a continuous supply of goods in stock ready for shipping in a timely manner.
(c) Delivery of Goods. Seller is solely responsible for delivery of Goods to sales customer and any associated delivery charges.
(d) Delivery Requirements: Items must be shipped using the respective methods below.We highly encourage our sellers to ship items within the specified time frame, and ask that you contact us ahead of time in case of sickness or holidays that may interfere with shipment of goods.
* e-patterns: via email within 48
hours of receipt of customer’s order.
* mailed paper patterns: via USPS 1st class mail within 3-4 days of receipt of customer’s order.
* books & other media: via USPS Media Mail or Priority Mail with delivery confirmation within 4-5 days of receipt of customer's order.
* rug hooking patterns: (non-paper based patterns) via USPS priority mail with delivery confirmation within 4-5 days of receipt of
customer’s order.
*kits & finished items: (ssembled kits and finished items)
via USPS priority mail with delivery confirmation within 4-5 days of customer’s order, or within the length of time specified on product submission form.
(e) Return of Goods.Unless due to a mistake made by Prim Folk, all customer complaints, requests for refunds, exchanges or returns are the sole responsibility of the seller.
Exchanges and refunds are granted under the following terms:
* customer files a request within 10 days from receipt of order.
* wrong item sent
* item received in bad/damaged condition.
Any costs incurred directly by Prim Folk as a result of a seller's failure to refund cost of sale to a qualifying customer will be charged to the seller.
3. Removal:
Prim Folk reserves the right to remove a seller at any time for any reason, but most especially for the following:
Situation: 3 validated customer complaints within a 6 month period regarding any of the following: late delivery, non-delivery, missent item, damaged item, poor packaging, or poor quality.
Action: deletion from all catalogs and sites
Situation: Failure to submit a refund request payment to a qualifying customer.
Action: deletion from all catalogs and sites; Seller charged for any cost incurred.
Situation: Gross incompliance with terms of this agreement
Action: deletion from all catalogs and sites.
6. Incentives:
To show our appreciation for a job well done, from time to time we we will reward Designers who demonstrate top notch customer service and order follow through.
Possible bonuses & rewards include:
1) Free inclusion of product(s) in National Magazine Page display ads, such as Country Sampler
2) Free spotlight ad at the Pitchy Patch Primitive Marketplace directory
3) Free Banner Rotation in the Pitchy Patch Primitive Marketplace directory
4) Products spotlighted on Prim Folk home page
7. Free Added Bonus:
All Designers who sell through Prim Folk get 1 website listed for FREE in
The Pitchy Patch Primitive Market directory.
8. Referral Program :
